Many have asked the question as to what procedures should be followed if a school district or public charter school does not wish to offer a new contract for the 2013-2014 school year to a teacher who is currently working under a Category A contract, or the second year of a Category B contract. This is especially important since all teachers working under the second year of a Category B contract, and all teachers working under a Category A contract who are currently in their third or greater consecutive year with their current employer, will need to be given a Renewable (or tenure) contract if they are re-employed for the 2013-2014 school year. In the wake of the November 2012 repeal of Students Come First, the 2013 Idaho Legislature passed House Bill 224 to remove any confusion that may have existed as to which set of laws governed the contracts that employees signed for the 2012-2013 school year. This legislation makes it clear that it is the laws that were in effect at the time the contracts were signed that will continue to govern those contracts through their natural expiration. This means that it is the non-renewal procedures that were in place at the time the 2012-2013 contracts were signed that must be followed if a school district or public charter school does not wish to offer a new 2013-2014 contract to a current employee who holds a Category A or B contract.
